car with notice of encumbrance from BIR

Hi need help here pls.. i bought pre owned car year 2012. M not d 2nd owner.  Was able to renew the registration without any alarm and transfered the ownership into my name last year.. last february i decided to sell the car. Here's my problem now, when the new owner renew its registration with and wanted to transfer the ownership into his, the car appeared to be in the alarm status. Indicating: " with notice of encumbrance from BIR dated september last year signed by its chief collection officer". How did this happen? It wasn't like this before and the original CR did not indicate that the car was "encumbered".. and how come it is the BIR was the signatory of the notice.. and how come it was only last year they put it in alarm status?. What to do with this situation?? Please badly need your help..

On the first place, how come it took you 3 years to transfer it to your name? Does the notice dated after you had transferred it to your name last year?
Don't expect the updated status especially in LTO and MMDA.
Well past is past, just proceed to LTO and inquire about it.

Yeah it's a mistake on my part.. took it for granted cause m not always in phil. According to LTO data notice of encumbrance signed on september, but alarmed on october just after it was already transferred on my name..

Just present all the documentation you have to the LTO and ask how to solve this problem of yours. There might have been a clerical error somewhere along the way.

They said I need to go to BIR regional office that sent them the alarm, all i need to do is to give them the proof that i bought the car before the date they sent the notice of encumbrance like deed of sale and my new CR..

Just a big hassle, it seems that there was a clerical error somewhere along the way like a wrong number entered or something. Good to know that it can be resolved.

This is also one of the reasons why buyers have to immediately transfer the CR/OR in the their name.

There is a new bill filed in Congress that will require this. Because it is technically a case of driving an  unregistered motor vehicle when do you not transfer ownership after purchasing. One cannot simply go around driving a car with just the deed of sale as proof of ownership.
