Guys! Need help. I was in LTO office earlier for my renewal of OR/CR, when the staff encoded the details we found out that my car was trasferred to another person last September 2015. They haven't process my renewal because it was not under my name. Howcome it was registered to someone that supposed to be mine??? How do things happen such as this.. Please help!

Did you buy car new or pre-owned?

I bought it bought it brand bew sir. I have the OR/CR under my name (photocopy) the original is in the bank which I verified they still have the copy. The bank told me it was impossible to have it transferred because they have my supporting docs.

Since the car is encumbered to the bank, which means they technically own it still. They have to help you fix the problem. Possible or impossible, they have to help you.

Hi need help here pls.. i bought pre owned car year 2012. M not d 2nd owner.  Was able to renew the registration without any alarm and transfered the ownership into my name last year.. last february i decided to sell the car. Here's my problem now, when the new owner renew its registration with and wanted to transfer the ownership into his, the car appeared to be in the alarm status. Indicating: " with notice of encumbrance from BIR dated september last year signed by its chief collection officer". How did this happen? It wasn't like this before and the original CR did not indicate that the car was "encumbered".. and how come it is the BIR was the signatory of the notice.. and how come it was only last year they put it in alarm status?. What to do with this situation?? Please badly need your help..

Hello,

Need some help here po:
What if the scenario's like this:
Buyer 1 buys car from Seller 1 but has not transferred the ownership yet to him. Now here comes Buyer 2 who bought the car from Buyer 1. Still, the ownership of the car belongs to the original seller. Although the registration of the car is up to date, the ORIGINAL Certificate of Registration went missing/misplaced. Buyer 2 already used the car with all the documents except the Cert. of Reg. Buyer 2 also would now want to transfer the ownership to him. What would be the remedy for this situation?

Your response to this comment would really be of great help.
Thank you & God bless!

-Michelle-

Hi Admin,

I would like to know your idea on what can be done on my case.

2015 was when I won my car via a Bingo Bonanza from my previous employer. However the OR/CR still shows the name of my old company so technically, they still own the car. I left the country for a year so I was not able to arrange it. What will I do so I can proceed with the transfer? Will this be tedious and expensive? Do I need a Deed of Sale or Deed of Donation?

Please help.

Thank you.

Don

yes, you would need the document stating that you bought or won the car. otherwise, you can't transfer it. 2015 is not that long ago and i'm pretty sure you don't have any issues with your previous employer. i'm quite surprised they didn't give you a document, because if someone used your car in the commission of a crime, they would be liable.
