Guys! Need help. I was in LTO office earlier for my renewal of OR/CR, when the staff encoded the details we found out that my car was trasferred to another person last September 2015. They haven't process my renewal because it was not under my name. Howcome it was registered to someone that supposed to be mine??? How do things happen such as this.. Please help!

Did you buy car new or pre-owned?

Tino

I bought it bought it brand bew sir. I have the OR/CR under my name (photocopy) the original is in the bank which I verified they still have the copy. The bank told me it was impossible to have it transferred because they have my supporting docs.

Since the car is encumbered to the bank, which means they technically own it still. They have to help you fix the problem. Possible or impossible, they have to help you.

Hi need help here pls.. i bought pre owned car year 2012. M not d 2nd owner.  Was able to renew the registration without any alarm and transfered the ownership into my name last year.. last february i decided to sell the car. Here's my problem now, when the new owner renew its registration with and wanted to transfer the ownership into his, the car appeared to be in the alarm status. Indicating: " with notice of encumbrance from BIR dated september last year signed by its chief collection officer". How did this happen? It wasn't like this before and the original CR did not indicate that the car was "encumbered".. and how come it is the BIR was the signatory of the notice.. and how come it was only last year they put it in alarm status?. What to do with this situation?? Please badly need your help..

Hello,

Need some help here po:
What if the scenario's like this:
Buyer 1 buys car from Seller 1 but has not transferred the ownership yet to him. Now here comes Buyer 2 who bought the car from Buyer 1. Still, the ownership of the car belongs to the original seller. Although the registration of the car is up to date, the ORIGINAL Certificate of Registration went missing/misplaced. Buyer 2 already used the car with all the documents except the Cert. of Reg. Buyer 2 also would now want to transfer the ownership to him. What would be the remedy for this situation?

Your response to this comment would really be of great help.
Thank you & God bless!

Hi Admin,

I would like to know your idea on what can be done on my case.

2015 was when I won my car via a Bingo Bonanza from my previous employer. However the OR/CR still shows the name of my old company so technically, they still own the car. I left the country for a year so I was not able to arrange it. What will I do so I can proceed with the transfer? Will this be tedious and expensive? Do I need a Deed of Sale or Deed of Donation?

Please help.

Thank you.

yes, you would need the document stating that you bought or won the car. otherwise, you can't transfer it. 2015 is not that long ago and i'm pretty sure you don't have any issues with your previous employer. i'm quite surprised they didn't give you a document, because if someone used your car in the commission of a crime, they would be liable.

Bumili ako ng car from a person . Nabili nya ung car sa bank. Ung car voluntary surrendered by the 1st owner to the bank. Ngayon nung ittransfer ko na, na misplace ko yung copy ng id nung registered owner which was the 1st owner. Pano  pogagawin ko?

you have a big problem. because you should have transferred ownership when you purchased the car.

good day guys sana matulungan niyo ako sa mga questions ko im planning to buy a civic hatch, dream car ko kasi noon pa. im eyeing one right now after going through some cars. super clean pa kasi yung body walang bulok and almost all stock pa lahat and good price din kaya plan ko na siya bilhin kaso magkakaproblema ata pag pag transfer sa name ko once i buy it

-sa 1st owner parin nakaregister yung car. si seller ang 3rd owner meron sila deed of sale ni 2nd owner may pirma nila pareho pero hindi notarized. notarized yung deed of sale ni 1st owner and 2nd owner. pwede ko ba panotarized yung deed of sale ni 2nd owner to seller tapos gawa ulit dos from seller to me?

-kung pwede yung nasa taas, sa photocopy kasi ng ids ni 1st and 2nd owner expired na yung license nila expires in 2003 kay 1st owner and 2015 kay 2nd owner tapos wala pa yung 3 signatures nila. ang problem rin is hindi na sila mahanap pano kaya gagawin dito kung sakali

salamat

@josh

your situation is a lot more complicated than what it seems. maybe best to ask the lto directly if you can legally execute this transfer. that's the problem with non requirement of transfer when you sell a car here in the country.

you'd have to transfer it to your name first. it'd be illegal to transact a sale in behalf of a deceased person.

Hi mga sir. Here's my question / scenario.

last year, may 2016, We purchased a preowned car from PSBank thru bidding under the name of my girlfriend / partner. Reason was we already used my name on another bid / entry. Fortunately, hers won. Her name was indicated on the DOS. My questions are :

Can I have it changed under my name? what requirements will be needed?

If we plan to sell it, RFS is to purchase a larger vehicle, Do we need to request transfer first?
On the CR, it is still encumbered. The bank gave us the documents necessary for transfer, cancellation of mortgage.
