Even if its not your fault, local laws will always make it seem like you are at fault.  The 'investigator' probably doesn't even know s*it about crash investigation and will just pronounce you at fault just because you were the one behind and because he is too lazy to actually investigate the circumstances that lead to the crash.  Never mind if the jeep has no taillamps, stopped abruptly in the middle of the road [to pick up passengers] or intentionally backed into you, you will still be made to look at fault.  That's how stupid local laws are.  Kaya malakas ang loob ng jeep huminto kahit saan, because they know that if they are rear-ended, it's payday for them.

Sometimes the tables do turn.  I was rear ended by a jeepney once.  The driver was inattentive of the road.  Thankfully, I was driving an SUV and sustained no damage.  I couldn't say the same for his mangled front end.

The Pajero backed up quite fast on that one to move that LC100. I'm there's one really pissed congressman.

in your opinion it's the rear car fault if the jeep suddenly stop without any light available or warning.,because sometimes policemen here are lazy to investigate so that i think everytime they see a car crash the rear car is the one who's reponsible for that.,don't tell drive defensively,  even you are so defensive and carefull,,when a car suddenly stop at you without any sign of warning i think you can hit them ., hopefully it will not happen to you because i will laugh at you if you argue with the jeepney driver or car in front of you. :)

Yeah, that's perhaps the only way to describe how that large SUV got moved sideways into an adjacent vehicle.

With the way supposed accident investigators haphazardly do their jobs, it's always a given that the car in front gets hit by the car following behind it. They will always initially (and until contested) declare V2 guilty of hitting V1. If you assert yourself, only then will they take a look at other circumstances, like vehicle positions, reasons for stopping at that area, brake lights perhaps. Oh, they also like to conclude that you were racing that's why you did not have time to stop/swerve and miss whatever vehicle you hit. Never mind if the PUV made a full stop in the middle of the road to pick up a passenger.

Being a pinoy, and used to pinoy driving conditions, it pains me to say this (mostly because I know I may well find myself in the same situation), but...

Don't you think that if V2 was "maintaining a safe distance" behind V1, he would have time to react even if V1 was forced to make a sudden stop?

Traffic rules across most nations are governed by the Vienna Convention on Road Traffic, among the signatories are the USA and the UK. Since our own road rules are largely based on US rules, it follows that our "safe distance" and tailgating rules are similar that those mentioned in the traffic code, and the highway code.

Now, from the Highway Code Online:

105: Drive at a speed that will allow you to stop well within the distance you can see to be clear. You should

  • leave enough space between you and the vehicle in front so that you can pull up safely if it suddenly slows down or stops. The safe rule is never to get closer than the overall stopping distance (see Typical Stopping Distances diagram below)

So let's say typical Jeep territory means about 30Mph. Was V2 at least 75 feet away from the car in front? If not, then according to the Vienna Convention, V2 is at fault, regardless of our jeep suddenly stopping to pick up a fare in the middle of the road.

i guess you were about to overtake when the jeep suddenly pulled over. ::) You were pulling too much momentum compared to the distance?

Jeepneys can really pist your day big time. But an once of patience can make a difference. Drive with a lot of caution specially behind a stop and go jeep. I heard of an accident involving a jeep passenger. Both the legs were amputated. Victim was trapped between the jeep and the car that crashed onto it. :-[ I just heard of it. be it true or not i know this is not a good thing to happen.

nice factual analysis, splerdu.  given our road and traffic conditions though, wishful thinking lang to have that rule followed. 

also, most PUV drivers have no clue regarding traffic rules and regulations.  i used to think they were just bullies -- but a huge number honestly do not know the rules.  i saw a docu on this way back in the 90's -- when quized on road signs -- puro head-scratching lang.  :(

best pa rin defensive driving.  always assume that other vehicles on the road are clueless.

They do have a clue.  I used to eat at a carinderia/lugawan frequented by jeepney drivers.  Pakinggan mo lang mga usapan nila.  Pinagtatawanan pa yung mga nakakabangga sa kanila sa likod kahit alam na alam nilang kasalanan nila (nag-pick up ng pasahero sa gitna) pero assured na assured silang they will get away scot-free.

Ang textbook case ko nito ay si boybi (of Tsikot.com).  A jeepney overtook him on the shoulder of the NLEX.  Upon overtaking him, jeepney slams on brakes.  Wasak ang sasakyan ni boybi.  Yung jeepney driver pa ang sumisingil sa kanya after kasi si boybi daw ang bumangga sa kanya.  Eh hindi naman sila magkakabanggaan kung hindi isa't kalahating tanga yung jeep na oovertake sa shoulder.

That is why in cases like that, you make sure they become a really bad accident that they will not see the light of day anymore. Di naman ikaw may kasalanan bobo sila magdrive eh. Nobody will miss them as well, they're useless parts of society. They do not pay taxes.

The problem with the Vienna convention is that it is too idealized.  Even on the freeway, you don't drive 18 carlenghts away front the vehicle in front.  Five CL's is the typical real-world distance on a busy freeway.

And the Vienna convention/Highway Code is based on the assumption that both vehicles are in excellent condition (vehicles where the highway code is enforced have MoT's).  Which means V1 actually has brake lamps to begin with.

Loading and unloading of public vehicles in the middle of a public road is also considered unlawful even in our lax local laws.
